Drug user needs to be seen as a patient according to the NDPS Act 1985.

  NDPD Act 1985 was introduced in 1985 to regulate the use of drugs and so it could be only used in medicinal drugs.

according to World Drug Report 2021, 275 Million used drugs last year, 36 million people suffer from drug-related disaster the way the drugs is becoming common in youths, is deteriorating their health and growth. 


to treat drug-related problems the government should have executed the existing laws more effectively to restrict the imports of drugs.

and the people who consume drugs should be treated as a patient because they are addicted to drugs, so the government should bring the amendment in the existing NDPS Act 1985 and decriminalize the drug in small quantities as a mental disorder not an act of crime. 

so the scenario of India demands that the criminal prosecution of such people who are addicted to drugs should be revoked and treat them as a patient with mental disorders. 

  •    as the government had done by revoking the IPC 309, and decrimalise the attempt of suicide, and treated those people as a patient of mental disorder, and provision was made to send those people in rehabilitaion centre. 

 

so it is imperative to treat addicted people to drug should be treated as patient because,















  •    They should get the opportunity to recover from their addiction to drugs.
  • once an individual is labeled as a criminal, it adversely affects their carrier and growth. 
  •   they may not get the normal treatment in society as they were getting before the prosecution in the criminal case.
  •   this will further lead the individual to the path of the crime and may depress them once they release from prison.
  •   prosecution in drugs case will taint their image in society, and they may become the subject of a boycott.

What Next-



  so it is imperative to bring the amendment to the NDPS Act to decriminalize the consumption of drugs like Portugal and many European countries have done already. their drug-addicted person is seen as a patient. 

          I think this is the right time to bring this amendment, so the affected person could seek adequate treatment.
