Anti Defection Law 10th schedule and its flows.

yes, to some extent the anti-defection law has curved the evil of political defection which was embedded in the Indian political system until the former PM Rajiv Gandhi brought this law inexistent,

But still, there are some flaws in law which is undermining its efficacy, for instance,

  • it undermines the rights of speech and expression of MLA's or MP's in assembly.
  • they cannot vote contrary to the direction given by the political parties.
  • they have to vote according to the instruction given by the political party, thus intervening in the individual approach to a particular cause.
  • and if they vote contrary to the direction of a political party. then they have to face disqualification.
  • and this law is also often criticized as it allows the defection in minorities.
no, doubt the anti-defection law is efficacious and working of it has maintained the stability in Indian political system.

But the flows or irregularities in it need to be addressed to make it more efficacious, so the stability of government could be ensured.

the political system of India is stable but in order to make it extremely stable the anti-defection law needs amendment as the law was amended 30 years ago, and its provisions are not deemed fit in presence, as in M.P., and Pondicherry the government were toppled queenright, and therefore the state and UT's faced instability.
