Capital punishment neither justice nor deterence against any crime. ?

 

capital punishment :                  

  yes, it is the veracity that we need to acknowledge, capital punishment provides neither justice nor deterrence, instead, it put those people at a disadvantage who are on death row.

   it is also noticed that the people who are on death row faces cognitive disabilities as well as a psychotic episodes, so they are subject to rehabilitates not for capital punishment.

    even amnesty international is not in favor of capital punishment as it says that capital punishment is in violation of the right to life and right to be free from cruel and inhuman on degrading or punishment. Both rights are protected under the united nation declaration and human rights adopted in 1948.

   and even the justice Varma committee of the supreme court recommended that capital punishment should be a last resort and should be given only heinous crimes.

      there are several countries that have revoked capital punishment in compliance with international standards like Canada, Australia, Mexico, but India did not revoke it yet.

The rationale behind the revocation of capital punishment is

  1. it is a violation of the international standard set up by UNHRC.
  2. it is inhuman and cruel.
  3. it denies the possibility of rehabilitation for those who are intellectually disabled.
  4. it is inefficient as it failed to create any deterrence to criminals according to NCRB.
  5. it inflicts more pain to the families of people on death row. 

What Next :

       the famous quote of M.K. Gandhi is" an eye for an eye makes the whole world blink." . indicates that capital punishment should not be used in any form of crime. instead, it can be reduced to life imprisonment.
